Use of the Consent Agenda permits the Board of Education to make more effective use of its time by adopting a single motion to cover those relatively routine matters, which are included. Any member of the Board who wishes to discuss individually a particular piece of business on the Consent Agenda may so indicate and that item will be considered and voted on separately, thus preserving the right of all Board members to be heard on any issue. It is recommended that the Board of Education approve the following Consent agenda as submitted by the Superintendent of Schools.

5.2 BE IT RESOLVED, that the Board of Education hereby approves the Contract with the Pleasantville Union Free School District for special education services for two students (ID# xxxxx2 & xxxxxx4) during the 2022-23 school year, and authorizes the Board President to execute this Agreement.
5.3 BE IT RESOLVED, that the Board of Education hereby approves a contract for special education services with North Salem Central School District for 1 student (#xxxxx4), effective September 6, 2022 to June 22, 2023, and authorizes the Board President to execute the contract.

5.11 BE IT RESOLVED, that the Board of Education hereby approves Bid Award Recommendation #B2022-12: Pest Control Services to JP McHale, for the 2022-23 school year at various prices.
5.12 BE IT RESOLVED, that the Board of Education hereby approves Bid Award Recommendation #B2022-13: Constructional, Labor & Materials – Painting Services to HG Painting, for the 2022-23 school year at various prices.
5.13 CCSD BID #B2022-14 - RESOLUTION
WHEREAS, the Board of Education, in accordance with Article 5-A of the General Municipal Law, invited sealed bids for Paint and Field Supplies; and
WHEREAS, the bids were opened publicly on September 29th, 2022 and zero bids were received for Paint and Field Supplies; and
WHEREAS, the Board of Education believes it to be in the best interests of the School District to reject and rebid Paint and Field Supplies;
THEREFORE, BE IT RESOLVED, that the Board of Education, in the best interests of the School District, hereby rejects the bid for Paint and Field Supplies, on the basis that zero bids were received for such Contract, and directs that it be rebid.
5.14 BE IT RESOLVED, that the Board of Education hereby approves Bid Award Recommendation #B2022-15: Generator Maintenance and Service to National Standby Repair, in the amount of $2,420.00 plus labor and materials for service when needed.
5.15 WHEREAS, the Board of Education of the Chappaqua Central School District is considering undertaking certain improvements to Horace Greeley High School, Robert Bell Middle School, Seven Bridges Middle School, Grafflin Elementary School, Westorchard Elementary School and Roaring Brook Elementary School (collectively, the “Project”), comprising maintenance upgrades and other improvements, including: resurfacing of existing parking surfaces and playgrounds, athletic field enhancements (e.g., resurfacing of fields with turf, field lighting, running track, bleachers), fencing repair and replacement, roof improvements/repairs, interior communications and mechanical system upgrades, and interior room improvements; the Project would also include the construction of new connecting corridor building additions, new storage and restroom buildings, and additional underground utility conduits at Horace Greeley High School, adding approximately 11,820 square feet of additional building floor area; and
WHEREAS, pursuant to the State Environmental Quality Review Act statute (Article 8 of the Environmental Conservation Law) and implementing regulations (“SEQRA”), the Board of Education has determined that the majority of the components of the Project would constitute “routine activities of educational institutions”, defined as Type II actions in Section 617.5 of Title 6 of the New York Codes, Rules and Regulations, and therefore would not be subject to environmental impact review under SEQRA; however, as the proposed modifications to Horace Greeley High School would exceed the 10,000 square foot threshold for Type II consideration, the Project as a whole was treated as an “Unlisted” action under SEQRA; and
WHEREAS, to assist it in its decision-making and planning, the Board of Education authorized KG+D Architects, PC to prepare an Environmental Assessment Form (“EAF”) to evaluate the Project’s potential for environmental impacts, which document, dated as of September 20, 2022, is attached hereto as Exhibit “A”; and
WHEREAS, on September 1, 2022, the Board of Education provided its Notice of Intent to serve as lead agency to all potentially involved or interested agencies, which was not objected to by other involved or interested agencies; and
WHEREAS, the EAF, including the documentation appended thereto, concludes that, inter alia, the proposed ground disturbance associated with the Project would be limited to approximately 3,000 square feet at Seven Bridges Middle School and approximately 21,200 square feet at Horace Greeley High School, and is anticipated to occur over the course of 15 months; that the Project would potentially add an additional 0.1 acre of impervious surface within the New York City, which would be addressed through permitting by the New York City Department of Environmental Protection; that potential erosion during the period of ground disturbance would be minimized or avoided through the implementation of a Stormwater Pollution Prevention Plan, which will include an erosion and sediment control plan; that, at a minimum, the erosion and sediment control plan would specify construction staging, installation and management of conventional erosion and sedimentation controls, and design elements for stormwater management post construction; that, with the implementation of appropriate sediment control measures, no significant adverse impacts to surface water or soil resources are expected; and
WHEREAS, the Project’s proposed exterior building modifications, building additions, and athletic field improvements would not cause any significant adverse environmental impacts, including visual or historic character impacts, to National Register Eligible properties , including the Readers Digest Headquarters, due to their respective locations, existing visual relationship, and the overall context of the urban setting; and that while Robert Bell Middle School is a National Register Eligible structure and is located near the State and National Register-listed Church of St. Mary the Virgin & Greeley Grove, the interior renovations contemplated for the school would be implemented in coordination with the New York State Historic Preservation Office and would not have any significant adverse environmental impacts; and
WHEREAS, the EAF, including the documentation appended thereto, concludes that, inter alia, that there are no sensitive natural communities, habitats or species mapped or observed to exist on or near the already-developed Project site, and therefore no significant adverse impacts to ecological resources are anticipated; and
WHEREAS, the remaining Project Elements at Robert Bell Middle School, Roaring Brook Elementary School, Westorchard Elementary School, and Grafflin Elementary School, including resurfacing of existing paved areas and playgrounds, internal building construction/improvements, roof improvements/repairs, and fencing repair and replace, do not require extensive excavation and would not result in any significant adverse environmental impacts;
THEREFORE, BE IT RESOLVED, that the Board of Education, pursuant to 6 NYCRR Part 617, finds that based on a review of information about the project contained in the EAF and any attachments hereto, which are incorporated by reference herein, the proposed actions would not have a significant adverse impact on the environment; and
BE IT FURTHER RESOLVED, that the Secretary shall file this Resolution with the District Office forthwith; and
BE IT FURTHER RESOLVED, that the Board will proceed to determine whether it will undertake the Project.
BY ORDER OF THE CHAPPAQUA CENTRAL SCHOOL DISTRICT BOARD OF EDUCATION
5.16 WHEREAS, the Board of Education of the Chappaqua Central School District is planning a project, using repair reserve funds, involving the repair of a portion of the roof at Westorchard Elementary School; Steam Line Valve Repair/Replacement and Competition Field Public Address System repair at Horace Greeley High School; and Library Air Conditioning Repair at Robert E. Bell Middle School (“Proposed Action”);
WHEREAS, the Board proposes to proceed with the Proposed Action and wishes to take all actions necessary in connection therewith in order to comply with the State Environmental Quality Review Act (“SEQRA”); and
WHEREAS, the Board has reviewed the Proposed Action with respect to the Type II criteria set forth in the SEQRA Regulations at 6 NYCRR Part 617.5 and has determined that the Proposed Action is a Type II action pursuant to the SEQRA Regulations at Section 617.5(c)(1) [maintenance or repair involving no substantial changes in the structure or facility] and/or (10) [routine activities of educational institutions];
NOW THEREFORE BE IT RESOLVED, that the Board of Education of the Chappaqua Central School District, as the only lead agency, determines that the Proposed Action is a Type II Action pursuant to §617.5(c)(1) and/or (10) of the SEQRA Regulations, will not have any significant environmental impacts and no further action is necessary.
5.17 RESOLUTION OF THE CHAPPAQUA CENTRAL SCHOOL DISTRICT, NEW YORK, ADOPTED OCTOBER 3, 2022, CALLING A SPECIAL DISTRICT MEETING TO AUTHORIZE THE EXPENDITURE OF MONEYS FOR SCHOOL PURPOSES AND THE LEVY OF A TAX THEREFOR.
RESOLVED BY THE BOARD OF EDUCATION OF THE CHAPPAQUA CENTRAL SCHOOL DISTRICT, IN THE COUNTY OF WESTCHESTER, NEW YORK AS FOLLOWS:
Section 1. A Special District Meeting of the qualified voters of the Chappaqua Central School District, in the County of Westchester, New York (the “District”), shall be held within the District, on Tuesday, November 29, 2022, at 7:00 o’clock A.M. (Prevailing Time) at the Gymnasium of the Horace Greeley High School, Chappaqua, New York, as provided in the Notice calling said Special District Meeting hereinafter substantially prescribed. The voting at such Special District Meeting shall be by ballot, as provided by the Education Law, and the polls shall remain open from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) on said day and as much longer as may be necessary to enable the voters, then present, to cast their votes.
Section 2. The business to be acted upon at said Special District Meeting shall be as stated in the Notice thereof, and the District Clerk is hereby authorized and directed to cause the Notice of said Special District Meeting to be published in “The Journal News” and “The Examiner,” two newspapers having a general circulation within the School District, such publications to be made four (4) times in each such newspaper within the seven (7) weeks next preceding such Special District Meeting, the first publications to be at least forty-five (45) days prior to the date of said Special District Meeting.
Section 3. Said Notice of Special District Meeting shall be substantially in the following form:

(a) That the Board of Education of the Chappaqua Central School District, in the County of Westchester, New York (the “District”), is hereby authorized to construct improvements and alterations to District school buildings and/or sites (the “Project”) substantially as described in a plan prepared by the District with the assistance of KG+D, Architects, P.C. (the “Plan”), available for public inspection in the office of the District Clerk, including (as and where necessary): roof replacements and/or reconstruction; improvements to the heating, ventilation, air conditioning, electrical, fire safety, lighting, and communications systems; bridge replacement; and site and athletic improvements including the construction of bathrooms, a storage building, playground resurfacing and a modified baseball field and paving improvements; all of the foregoing to include the original furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs, costs incidental thereto and to the financing thereof and interest during construction, an amount not to exceed the estimated total cost of $33,985,000; provided that the costs of the components of the Project as set forth in the Plan may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;
(b) that a tax is hereby voted in the aggregate amount of not to exceed $33,985,000 to pay such cost, said tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and
(c) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the principal amount of not to exceed $33,985,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

RESOLVED:
(a) That the Board of Education of the Chappaqua Central School District, in the County of Westchester, New York (the “District”), is hereby authorized to construct a single point of entry at Horace Greeley High School (the “Project”) substantially as described in a plan prepared by the District with the assistance of KG+D, Architects, P.C. (the “Plan”), available for public inspection in the office of the District Clerk, including (as and where necessary): including a new entrance and connector to gymnasium, and reconfiguration of main office; the foregoing to include the original furnishings, equipment, machinery, apparatus and ancillary or related site, demolition and other work required in connection therewith; and to expend therefor, including preliminary costs, costs incidental thereto and to the financing thereof and interest during construction, an amount not to exceed the estimated total cost of $11,340,000; provided that the costs of the components of the Project as set forth in the Plan may be reallocated among such components if the Board of Education shall determine that such reallocation is in the best interests of the District;
(b) that a tax is hereby voted in the aggregate amount of not to exceed $11,340,000 to pay such cost, said tax to be levied and collected in installments in such years and in such amounts as shall be determined by said Board of Education; and
(c) that in anticipation of said tax, bonds of the District are hereby authorized to be issued in the principal amount of not to exceed $11,340,000 and a tax is hereby voted to pay the interest on said bonds as the same shall become due and payable.

The voting will be conducted by ballot as provided in the Education Law and the polls will remain open from 7:00 o’clock A.M. to 9:00 o’clock P.M. (Prevailing Time) and as much longer as may be necessary to enable the voters then present to cast their ballots.
NOTICE IS FURTHER GIVEN that registration of voters is required pursuant to Section 2014 of the Education Law. If a voter has registered to vote with the School District and has voted at an annual or special school district meeting within the last four calendar years, (after January 1, 2018) s/he is eligible to vote at this Special District Meeting. If a voter is currently registered to vote with the Westchester County Board of Elections, s/he is also eligible to vote in this Special District Meeting. All other persons who wish to vote must register. Registration may be done on any business day at the office of the District Clerk, during business hours, at the Education Center at 66 Roaring Brook Road, Chappaqua, New York, up to November 23, 2022. Any person possessing all of the following qualifications may register to vote:
- Is a citizen of the United States; and
- Is eighteen years of age or older; and
- Has resided in the School District for a period of thirty days immediately preceding the day of the Special District Meeting.
NOTICE IS FURTHER GIVEN that the register of voters so prepared, including the names of military voters who submitted valid military registrations, shall be filed in the Office of the Clerk of the District and shall be open for inspection by any qualified voter of the District between the hours of 8:30 o’clock A.M. and 4:00 o’clock P.M., (Prevailing Time), beginning November 23, 2022, except legal holidays, Sunday and on Saturday, November 26, 2022 by appointment only. Said register will be open for inspection at the polling place on the date of the election and vote.
NOTICE IS FURTHER GIVEN that, applications for absentee ballots for said Special District Meeting may be obtained at the Office of the School District Clerk. The completed application must be received by the District Clerk no more than thirty (30) days and at least seven (7) days prior to the election if the ballot is to be mailed to the voter or the day before the Special District Meeting, if the ballot will be picked up personally at the District Clerk’s Office by the voter or the voter’s designated agent set forth in the application. Absentee ballots must be received by the District Clerk by no later than 5:00 o’clock P.M., (Prevailing Time), on November 29, 2022.
NOTICE IS FURTHER GIVEN that a list of all persons to whom absentee ballots shall have been issued and a list of all military voters to whom military ballots shall have been issued, will be available for inspection from qualified voters of the District in the said office of the District Clerk during regular office hours, 8:30 o’clock A.M. to 4:30 o’clock P.M., (Prevailing Time), until the day of the Special District Meeting. Any qualified voter may file a written challenge of the qualifications of a voter whose name appears on such list, stating the reasons for the challenge.
NOTICE IS FURTHER GIVEN that Military Voters who are not currently registered to vote may request an application to register as a qualified voter of the District and Military Voters who are registered to vote may request an application for a military ballot by contacting the District Clerk at 66 Roaring Brook Road, Chappaqua, NY 10514, Telephone (914) 238-7200, Ext. 1002 or email: lielsner@chappaquaschools.org, for the Special District Meeting on November 29, 2022. The Military Voter may indicate their preference for receiving the registration application and/or application for military ballot by mail, facsimile or email. The application to register and the application for military ballot must be received by the District Clerk no later than 5:00 P.M. (Prevailing Time) on November 3, 2022. Military ballots will be mailed or otherwise distributed no later than 25 days before the election. Military ballots must be returned by mail or in person and received by the District Clerk by 5:00 o’clock P.M. (Prevailing Time) on November 29, 2022.
Only qualified voters who are duly registered will be permitted to vote.

Section 4. The vote upon the Bond Propositions to be submitted to the qualified voters shall be by ballot and the District Clerk is hereby authorized and directed to have the necessary ballots in form corresponding as nearly as may be with the requirements of the Education Law.
Section 5. The proceeds of the bonds authorized pursuant to the Bond Propositions set forth in Section 3 hereof, and any bond anticipation notes issued in anticipation of said bonds, may be applied to reimburse the District for expenditures made for the purpose or purposes for which said bonds are authorized. The foregoing statement of intent with respect to reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
Section 6. This resolution shall take effect immediately.
5.18 BE IT RESOLVED, that the Board of Education hereby approves and agreement with Cross Court Pickleball LLC for facilities use and instructors by the Chappaqua Continuing Education Program for the 2022-23 school year, and authorizes the Board President to execute the agreement.
5.19 BE IT RESOLVED, that the Board of Education approves an amendment to the agreement with Sive, Paget, Riesel P.C., previously approved by the Board on June 3, 2021, dated September 29, 2022, and authorizes the Board President to execute the amendment.
5.20 BE IT RESOLVED, in accordance with General Municipal Law 6-d - Repair Reserve Fund, the Board of Education approves the appropriation of $138,000 from the Repair Reserve Fund to Budget code A 1621-436-34 Building Repair for the repair of a portion of the Westorchard Elementary School Roof, Steam Line Valve Replacement at Horace Greeley High School, Bell School Library Air Conditioning Repair and Horace Greeley Competition Field Public Address system repair.
5.21 BE IT RESOLVED, that the Board of Education hereby accepts the external audit report and management response for year ending June 30, 2022.
6. BE IT RESOLVED, that the Board of Education acknowledges the following contracts approved by the Superintendent, per Board Policy 6085 – Purchasing and Bidding:
6.1 An Agreement for Services with Norah McAvoy for fixed asset reconciliation services during the 2022-23 school year.
6.2 An Agreement with Project Adventure for Seven Bridges Challenge Course repairs.
