BE IT RESOLVED, that the Superintendent is hereby authorized to direct a comprehensive medical examination and evaluation, including but not limited to psychiatric and other examinations and evaluations, if necessary, of Employee No. 3661, in accordance with the provisions of Section 913 of the Education Law; and

BE IT FURTHER RESOLVED, that the Board hereby directs that Employee No. 3661 submit their medical records, if any, to the extent and for the time as determined by the physician(s) to the examining physician(s) at or before such examinations/evaluations.

Resignation:
Mr. Brad Gitlin, (.5) Teacher of Physical Education & (.5) Assistant Athletic Director, Horace Greeley High School, effective July 28, 2021.

Childcare Leave of Absence:

Appointment: Probationary
Ms. Paulina Riefenhauser, Teacher of Elementary Education, Roaring Brook Elementary School, to a probationary appointment in the tenure area of Elementary Education, effective August 30, 2021 through August 29, 2024, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period they shall not be eligible for tenure at that time.

Ms. Kerry Fitzgibbon, Teacher of Art, Robert E. Bell/Seven Bridges Middle Schools, to a probationary appointment in the tenure area of Art, effective August 30, 2021 through August 29, 2025, subject to receipt of composite or overall annual professional performance review ratings pursuant to Education law Section 3012-c and/or 3012-d of either effective or highly effective in at least three (3) of the four (4) proceeding years, and if the probationer receives an ineffective composite or overall rating in the final year of the probationary period they shall not be eligible for tenure at that time.

Rescind Request for Discretionary Leave of Absence:
BE IT RESOLVED, that the Board of Education hereby rescinds the authorized discretionary leave of absence, for Jenna Dallacco, teacher aide at Roaring Brook Elementary School, starting on or about September 21, 2021, using 10 sick days and then without pay through March 28, 2022.

Use of the Consent Agenda permits the Board of Education to make more effective use of its time by adopting a single motion to cover those relatively routine matters, which are included. Any member of the Board who wishes to discuss individually a particular piece of business on the Consent Agenda may so indicate and that item will be considered and voted on separately, thus preserving the right of all Board members to be heard on any issue. It is recommended that the Board of Education approve the following Consent agenda as submitted by the Superintendent of Schools.

2.1    WHEREAS, while the Governor has declared that the COVID-19 state of emergency has ended in New York State, there is an increase in the virus due to variants, particularly the Delta Variant, which largely affects those who are not fully vaccinated; and 

WHEREAS, it is anticipated that students will return to in-school learning in September 2021, with continued appropriate health and safety measures in place; and

WHEREAS, children who are under the age of 12 do not have the option to be vaccinated at this time and, in any event, cannot be fully vaccinated prior to the start of the 2021-2022 instructional year; and

WHEREAS, in order to ensure that such students and others in the schools who are not fully vaccinated can safely return to school in September 2021, it is necessary to purchase approximately 690 individual desks and 111 additional tables on an emergency basis for health and safety reasons, for use in the Elementary schools to enable social distancing in addition to the implementation and continuation of other health and safety measures to control and limit the spread of the virus; and

WHEREAS, the Board of Education is empowered to determine that the expense of this activity is an ordinary contingent expense within the meaning of §2023 of the New York State Education Law and §170.2(l) of the Regulations of the Commissioner of Education, and that the purchase constitutes an emergency within the meaning of §103 of the General Municipal Law and, therefore, competitive bidding shall not be required;

THEREFORE, BE IT RESOLVED, that the Board of Education recognizes an ongoing health and safety emergency for students who do not have the option of being vaccinated against the COVID-19 virus that warrants a need to procure health and safety measures, in the nature of individual desks and additional tables to enable social distancing at the Elementary schools, on an immediate and emergency basis, for the health, safety and welfare of the students and staff, thereby justifying the suspension of the bid law requirements of General Municipal Law §103 on the basis of emergency needs; and

BE IT FURTHER RESOLVED, that the Board of Education hereby appropriates not to exceed $250,000 to pay for the cost of such desks and tables from unappropriated unassigned fund balance in the general fund from the 2020-2021 school year, and authorizes the Superintendent of Schools or designee to transfer not to exceed $250,000 from unappropriated unassigned fund balance to Budget Code A2110200 to pay for the costs of such desks and tables, thereby increasing the Budget for the 2021-2022 school year by an amount not to exceed $250,000.  

2.2    BE IT RESOLVED, that the Board of Education hereby approves the purchase of the following items, priced under NYS Contract #PC66518, through AT Equipment Sales:

2.4    BE IT RESOLVED that the Board hereby authorizes its President to sign a General Release, as presented to the Board at this meeting, regarding work performed by School Construction Consultants, Inc., pursuant to a contract for construction management services dated October 18, 2016 and authorizes the payment of $60,000.00 in full and final satisfaction of the District’s obligations under said contract.
