NYS Regulations - Date of Exit UPDATE (1/21/25)

Dear Parents,

This memo is to inform you of updated information regarding the date a Chappaqua student with an Individualized Education Plan (IEP) will no longer be eligible for special education services from the school district.

By letter dated March 27, 2024, we advised parents whose children were turning 21 years old in the current school year about litigation that called into question when students with educational disabilities aged out of eligibility for special education services. In that letter, parents were advised that "all students with an IEP will be expected to exit their educational program at the end of the year that he/she turns 21 years of age."

We are writing this update to advise that the New York State Education Department has not yet appealed the Albany Supreme Court Decision referenced in our March 27, 2024 letter. Accordingly, the District's position as to when students with educational disabilities will age out of eligibility for special education services remains unchanged. All students with an IEP will continue to be expected to exit their educational program at the end of the year that he/she turns 21 years of age.

At this time, all students with an IEP will be expected to exit their educational program at the end of the year that he/she turns 21 years of age. Students, families, and service providers should prepare to focus on transition planning and post secondary options for these students, as they exit from the district.
