4020 - Independent Educational Evaluations

The Chappaqua Central School District shall pay for an Independent Educational Evaluation (IEE) when authorized by the Chairperson, Committee on Special Education/Pre-School Education or directed by an Impartial Hearing Officer.

An IEE is an individual evaluation of a student thought to have a disability or currently classified with an educational disability pursuant to the Individuals with Disabilities Education Act (IDEA) and Article 89 of the New York State Education Law, conducted by a qualified examiner who is not employed by the Chappaqua Central School District or any agency responsible for educating the student.

A parent may request an IEE at district expense if the parent disagrees with the evaluation conducted by the School District. Requests must be made in writing to the Chairperson, Committee on Special Education/Pre-School Education according to procedures outlined in Administrative Regulations.

The results of any IEE, whether at District expense or parental expense, shall be considered by the Committee on Special Education or Committee on Pre-School Education in decisions made with respect to the student's educational program.

The Board of Education hereby directs the Superintendent of Schools to develop regulations to ensure that information regarding IEEs is made available to parents who request the same. The Board further directs the Superintendent to develop regulations determining (1) the process for submitting and deciding upon requests; (2) the criteria under which an IEE at public expense may be obtained; and (3) a schedule of fees the District will pay for an IEE that do not exceed rates paid by Putnam/Northern Westchester BOCES for comparable evaluations in each discipline.
