8.       Recommended Action:  Other
Use of the Consent Agenda permits the Board of Education to make more effective use of its time by adopting a single motion to cover those relatively routine matters, which are included. Any member of the Board who wishes to discuss individually a particular piece of business on the Consent Agenda may so indicate and that item will be considered and voted on separately, thus preserving the right of all Board members to be heard on any issue. It is recommended that the Board of Education approve the following Consent agenda as submitted by the Superintendent of Schools.

8.1    CSE summaries (2022-23 School Year) reported to the Board on July 6, 2023.

8.2    CSE summaries (2023-24 School Year) reported to the Board on July 6, 2023.

8.3    BE IT RESOLVED, in accordance with Policy 9040, that based upon the recommendation of the Superintendent of Schools, employees in the following positions who are required to travel regularly among the buildings of the School District shall be entitled to a monthly car allowance of $200 for the 2023-24 school year as set forth below:

Assistant Superintendent for Curriculum and Instruction, Assistant Superintendent for Business, Assistant Superintendent for Human Resources and Leadership Development, Assistant Superintendent for Pupil Personnel Services, Director of Elementary Education K-6, Director of Technology & Innovation, Director of Special Education and 504 Services, Associate Director of Technology & Communication and Director of Athletics, Physical Education & Health.

8.4    BE IT RESOLVED, in the event that the Principal of the Horace Greeley High School is not physically present in the High School on one or more days (or portions thereof,) during the 2023-24 school year, that either Karime Flores, Ron Gamma, Lauralyn Stewart or Joseph Sullivan, Assistant Principals be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Geoff Curtis, Principal of the Robert E. Bell Middle School is not physically present in the Middle School on one or more days (or portions thereof,) during the 2023-24 school year, that the Assistant Principal be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Joseph Mazza, Principal of the Seven Bridges Middle School is not physically present in the Middle School on one or more days (or portions thereof,) during the 2023-24 school year, that Jessica Rappaport, Assistant Principal be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Deborah Alspach, Principal of Douglas Grafflin Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2023-24 school year, that Ryan Spillane, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Tonya Wilson, Principal of Roaring Brook Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2023-24 school year, that Ross Cooper, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that James Skoog, Principal of Westorchard Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2023-24 school year, that Jennifer Kean-Thompson, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT FURTHER RESOLVED, that the District Clerk shall forward a copy of this resolution to each of the above referenced persons.

8.5    Supplemental Defense and Indemnification Resolution for the 2023-24 School Year

WHEREAS, Section 18 of the Public Officers Law of the State of New York authorizes municipal corporations, including Boards of Education, to adopt supplemental defense and indemnification provisions to those contained in the Education Law; and

WHEREAS, the statute authorizes Boards of Education to defend, indemnify and save harmless, members of boards of education and officers, agents and employees of the Boards of Education and parent volunteers in connection with any claims asserted or judgment obtained against such board members, officers, agents or employees, including former employees, in any State or Federal Court, or in the amount of any settlement of any such claim, provided the act or omission from which such judgment or claim arose occurred while the Board member, officer, agent or employee was acting within the scope of his or her office of employment;

NOW THEREFORE, BE IT RESOLVED that the Board of Education of the Chappaqua Central School District hereby adopts the supplemental defense and indemnification provisions contained in Section 18 of the Public Officers Law for its Board members, officers, agents and employees, and parent volunteers on school-based planning and shared decision making committees or other community volunteer performing volunteer service with the consent of the Board and/or Superintendent of Schools. This coverage shall supplement and shall be in addition to the coverage available to such employees under other enactments, including but not limited to the Education Law of the State of New York.

8.6    BE IT RESOLVED, that the Board of Education hereby approves a retainer agreement with Shaw, Perelson, May & Lambert LLC, effective July 1, 2023 for the 2023-24 school year, and authorizes the Board President to execute this agreement.

8.7    BE IT RESOLVED, that the Board of Education hereby approves a retainer agreement, dated June 26, 2019, with PKF O’Connor Davies, LLP, effective July 1, 2021 for the 2023-24 school year, and authorizes the Board President to execute the agreement.

8.8    BE IT RESOLVED, that the Board of Education hereby approves an agreement with the City School District of New Rochelle for Health & Welfare Services during the 2022-23 school year for 2 students, in the amount of $1,427.00 per student, and authorizes the Superintendent and Board President to execute the agreement.

8.9    BE IT RESOLVED, that the Board of Education hereby approves an agreement with the Union Free School District of the Tarrytowns for Health & Welfare Services during the 2022-23 school year for 24 students, in the amount of $1,106.93 per student, and authorizes the Superintendent and Board President to execute the agreement.

8.10    BE IT RESOLVED, that the Board of Education hereby approves an agreement for services with AF Investigations, Inc., for investigative services during the 2023-24 school year, and authorizes the Board President to execute the agreement.

8.11    BE IT RESOLVED, that the Board of Education approves the agreement with Anderson Center for Autism, effective July 1, 2023 through June 30, 2024 for provision of a special education program based on the New York State Education Department and the Office of Children and Family Services rates as outlined in Appendix A of the Agreement, and authorizes the Board President to execute the agreement.

8.12    WHEREAS, SchoolPass is and will continue to be, the sole source of SchoolPass. This is a proprietary product that is only available through SchoolPass located at 267 Kentlands Blvd., #2034, Gaithersburg, MD 20878.

WHEREAS, SchoolPass will have a direct sales and purchasing relationship and no intentions to utilize agents, or authorize resellers to provide SchoolPass products and services to Chappaqua School Central School District.
    
THEREFORE, BE IT RESOLVED, that the Board of Education hereby declares SchoolPass to be the sole source for all SchoolPass branded products and services purchased in the ordinary course of product acquisition and therefore, determines that the purchase of the SchoolPass products is not subject to competitive bidding under Section 103 of the General Municipal Law. 

NOW THEREFORE BE IT ALSO RESOLVED, that the Board of Education hereby approves a Master Services Agreement with SchoolPass for license plate readers and attendance tracking at Horace Greeley High School, effective July 15, 2023, and authorizes the Board President to execute the agreement.

8.13    BE IT RESOLVED, that the Board of Education hereby approves an Agreement with Student Assistance Services for the 2023-2024 school year for a five-day per week Student Assistance Counselor at Horace Greeley High School, in the amount of $80,732.00, and authorizes the Board President to execute this Agreement.

8.14    WHEREAS, the District owns the attached list of items which are no longer useful or  necessary for school district purposes and of no value to the School District; 
THEREFORE, BE IT RESOLVED, that the Board hereby declares such items to be surplus property and of no value to the School District and authorizes the disposal of such equipment in a prudent manner in accordance with law.

8.15    BE IT RESOLVED, that the Board of Education hereby approves an agreement with LogicPrep for SAT and ACT prep courses for the 2023-24 school year, and authorizes the Board President to execute the agreement.

8.16    BE IT RESOLVED, that the Board of Education hereby approves an increase to the “Sick/Compensated Absences” budget line (A2110-139-36-251) by the amount of $51,279.92, and the “Compensated Absences” budget line (A9089-880-36) by $95,608.25 as an additional budget appropriation to the 2022-2023 budget and that such appropriation be funded from the Employee Benefit Accrued Liability Reserve Fund.

8.17    BE IT RESOLVED, that the Board of Education hereby authorizes its attorneys, Shaw, Perelson, May & Lambert, LLP to execute a Consent Judgment in a tax certiorari proceeding captioned SG Option Lot 3 v. Town of New Castle and Chappaqua CSD;

AND BE IT FURTHER RESOLVED, that the Board of Education hereby authorizes the increase to the Refund on Real Property Taxes (A1964-400-36) utilizing the Tax Certiorari Reserve Fund and the refund of taxes as required by the terms of any Consent Judgments approved by the Board during the 2022-2023 school year.

8.18    BE IT RESOLVED, that the Board of Education hereby approve a budget transfer in the amount of $128,068.00, to cover the balance of the 2022-23 July-August summer ESY program not covered by New York State aid, and authorizes the Superintendent and Board President to approve the transfer.

8.19    BE IT RESOLVED, that the Board of Education hereby approve a budget transfer in the amount of $103,406.00, for the 2022-23 year-end salary overages under the substitute codes, and authorizes the Superintendent and Board President to approve the transfer.

8.20    RESOLVED that the Board of Education approve the terms of the Release and Settlement Agreement involving Student Number 700360, a copy of which shall be incorporated by reference in the minutes of this meeting; and
 
BE IT FURTHER RESOLVED that the Superintendent of Schools be and hereby is authorized to execute such Release and Settlement Agreement on behalf of the District.

8.21    BE IT RESOLVED, that the Board of Education hereby approves an agreement for services with Shelly DuBose for mathematics professional development and curriculum alignment during the 2023-24 school year, and authorizes the Board President to execute the agreement.

8.22    BE IT RESOLVED, that the Board of Education hereby approves an Agreement with Hawthorne Foundation, Inc. d/b/a Hawthorne Country Day School, effective July 1, 2023 through June 30, 2024 for provision of a special education program based on the New York State Education Department and the Office of Children and Family Services rates as outlined in Schedules B and C of the Agreement, and authorizes the Board President to execute the agreement.

8.23    BE IT RESOLVED, that the Board of Education hereby approves a service agreement with Anderson Center Consulting & Training for program-based services and behavioral consultation on an as-needed basis during the 2023-24 school year, and authorizes the Board President to execute the agreement.

8.24    WHEREAS, the Board of Education had requested bids for Food Service Management Program Operation to manage the school lunch program, effective September 1, 2023 in Bid #B2023-07; and

WHEREAS, an evaluation was done by Josh Culwell-Block, Assistant Superintendent for Business and Anne Holmquist, District Purchasing Agent; and 

NOW THEREFORE BE IT RESOLVED, that the Board of Education awards the bid for Food Service Management Program Operation to Aramark Educational Services, based upon the recommendation made by Josh Culwell-Block, Assistant Superintendent for Business and Anne Holmquist, District Purchasing Agent, as the lowest responsible bidder responsive to the specifications as stipulated in the bid documents for Bid #B2023-07.

AND BE IT FURTHER RESOLVED, that the BOE President is authorized to execute the contract with Aramark Educational Services, a copy of which contract is incorporated by reference within the minutes of this meeting.

8.25    BE IT RESOLVED, that the Board of Education hereby approves Bid Supplemental Award  Recommendation CCSD #B2023-09:  Printing/Stationery Services for the 2023-24 school year to KM Printing, LLC DBA Strategic Factory, Checkomatic and Courier Printing, at various amounts.

8.26    BE IT RESOLVED, that the Board of Education hereby approves Bid Award Recommendation CCSD #B2023-10:  Educational Data Services – various categories for the 2023-24 school year, in the amount of $102,958.31.

8.27     BE IT RESOLVED, that the Board of Education hereby approves a maintenance agreement with Select Telecom for the Mitel IP Office Telephone and Voice Mail System, effective July 14, 2023 through July 13, 2024, and authorizes the Board President to execute the agreement.

9.       BE IT RESOLVED, that the Board of Education acknowledges the following contracts approved by the Superintendent, per Board Policy 6085 – Purchasing and Bidding:

9.1    An agreement for services with Laurie Armstrong Coaching & Consulting for an active coaching workshop during the 2023-24 school year.
