5.         Information Business Affairs

5.1       President’s Report - President Shepardson began her report by noting the following:

  • Thanking Hilary Grasso for her service as Board President during the 2021-22 school year.
  • Welcoming Ryan Kelsey to the Board.
  • Thanking District administrators for their work over the past couple of years and wishing them some “relax” time during the summer and complimenting them on a successful administrative retreat.  She then spoke briefly about the events of the retreat.
  • Reminding the community that a great deal of work gets done over the summer to prepare for the coming school year.

5.1.1    2022-2023 Board Committee/Liaison Assignments

5.2       Superintendent’s Report – Dr. Ackerman gave her community update noting the following:

  • Welcoming Ryan Kelsey to the Board.
  • Zauderer Property Update.
  • Chappaqua Children’s Workshop update regarding additional space in our schools.
  • Horace Greeley High School bridge issue.
  • Safety & Security Audit RFP update.
  • Dr. Pease gave an update on 8th Grade Algebra course offerings.
  • HGHS Principal Search process update.
  • Sharing a summer calendar and wishing everyone a wonderful summer.
  • Responding to Board Vice President Messner’s question regarding Naviance and SCOIR with a clarification of the process.

8.      Recommended Action:  Other
Use of the Consent Agenda permits the Board of Education to make more effective use of its time by adopting a single motion to cover those relatively routine matters, which are included. Any member of the Board who wishes to discuss individually a particular piece of business on the Consent Agenda may so indicate and that item will be considered and voted on separately, thus preserving the right of all Board members to be heard on any issue. It is recommended that the Board of Education approve the following Consent agenda as submitted by the Superintendent of Schools.

8.1    CSE summaries (2021-22 School Year) reported to the Board on July 6, 2022.

8.3    BE IT RESOLVED, in accordance with Policy 9040, that based upon the recommendation of the Superintendent of Schools, employees in the following positions who are required to travel regularly among the buildings of the School District shall be entitled to a monthly car allowance of $200 for the 2022-23 school year as set forth below:

Assistant Superintendent for Curriculum and Instruction, Assistant Superintendent for Business, Assistant Superintendent for Human Resources and Leadership Development, Assistant Superintendent for Pupil Personnel Services, Director of K-12 Literacy, Director of Technology, Innovation & Mathematics, Director of Special Education and 504 Services, Director of Equity, Inclusion & Wellness, Associate Director of Technology & Communication and Director of Athletics, Physical Education & Health.

8.4    BE IT RESOLVED, in the event that the Principal of the Horace Greeley High School is not physically present in the High School on one or more days (or portions thereof,) during the 2022-23 school year, that either Siska Brutsaert, Ron Gamma, or Lauralyn Stewart, Assistant Principals be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Geoff Curtis, Principal of the Robert E. Bell Middle School is not physically present in the Middle School on one or more days (or portions thereof,) during the 2022-23 school year, that Jennifer Kean-Thompson, Assistant Principal be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Joseph Mazza, Principal of the Seven Bridges Middle School is not physically present in the Middle School on one or more days (or portions thereof,) during the 2022-23 school year, that Jessica Rappaport, Assistant Principal be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Deborah Alspach, Principal of Douglas Grafflin Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2022-23 school year, that Ryan Spillane, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that Tonya Wilson, Principal of Roaring Brook Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2022-23 school year, that Ross Cooper, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT RESOLVED, in the event that James Skoog, Principal of Westorchard Elementary School, is not physically present in the Elementary School on one or more days (or portions thereof,) during the 2022-23 school year, that Alissa Stoever, Assistant Principal, be appointed Acting Principal for purposes of all short-term student discipline matters pursuant to Section 3214 of the New York State Education Law; and

BE IT FURTHER RESOLVED, that the District Clerk shall forward a copy of this resolution to each of the above referenced persons.

8.5    Supplemental Defense and Indemnification Resolution for the 2022-23 School Year

WHEREAS, Section 18 of the Public Officers Law of the State of New York authorizes municipal corporations, including Boards of Education, to adopt supplemental defense and indemnification provisions to those contained in the Education Law; and

WHEREAS, the statute authorizes Boards of Education to defend, indemnify and save harmless, members of boards of education and officers, agents and employees of the Boards of Education and parent volunteers in connection with any claims asserted or judgment obtained against such board members, officers, agents or employees, including former employees, in any State or Federal Court, or in the amount of any settlement of any such claim, provided the act or omission from which such judgment or claim arose occurred while the Board member, officer, agent or employee was acting within the scope of his or her office of employment;

NOW THEREFORE, BE IT RESOLVED that the Board of Education of the Chappaqua Central School District hereby adopts the supplemental defense and indemnification provisions contained in Section 18 of the Public Officers Law for its Board members, officers, agents and employees, and parent volunteers on school-based planning and shared decision making committees or other community volunteer performing volunteer service with the consent of the Board and/or Superintendent of Schools. This coverage shall supplement and shall be in addition to the coverage available to such employees under other enactments, including but not limited to the Education Law of the State of New York.

8.6    BE IT RESOLVED, that the Board of Education hereby approves PNW BOCES 2022-23 Contract of Services in the amount of $1,630,538.00 and authorizes the Board President and District Clerk to execute the agreement

8.7     BE IT RESOLVED, that the Board of Education hereby approves a retainer agreement, dated June 26, 2019, with PKF O’Connor Davies, LLP, effective July 1, 2021 for the 2022-23 school year, and authorizes the Board President to execute the Agreement.

8.8    BE IT RESOLVED, that the Board of Education hereby approves a retainer agreement with Shaw, Perelson, May & Lambert LLC, effective July 1, 2022 for the 2022-23 school year, and authorizes the Board President to execute this Agreement.

8.9    BE IT RESOLVED, that the Board of Education hereby approves a new 60 month postage meter agreement with Pitney Bowes for Douglas Grafflin, Roaring Brook and Westorchard Elementary Schools, Robert E. Bell and Seven Bridges Middle Schools, Horace Greeley High School, and the Education Center,  and authorizes the Board President to execute this agreement.

8.10    BE IT RESOLVED, that the Board of Education hereby accepts the recommendation of the Audit Committee to accept: 1) the Internal Audit Report – Review of Select Business Office Roles and Responsibilities and, 2) the School District Response to the Internal Audit Report, for the year ending June 30, 2022.

8.11    BE IT RESOLVED, that the Board of Education hereby approves the Aramark Contract Extension required by The Stated Education Department for the 2022-23 school year and authorizes the Superintendent and Board President to execute the extension of agreement.

8.12    WHEREAS, upon performing a condition inspection of the pedestrian bridge at Horace Greeley High School (“HGHS), at the District’s request, on June 4 and 10, 2022, Abeja Engineering PLLC determined that the pedestrian bridge is unsafe, cannot be used, and requires immediate repairs, including, but not limited to, replacement of Pier 1 columns, exposing the RC beams down to the reinforcing steel, replacement of corroded steel, and pouring new concrete around the new steel reinforcement; and

WHEREAS, the current condition of the pedestrian bridge at HGHS requires immediate action which cannot await normal permitting approval and competitive bidding, in order to assure that the pedestrian bridge is repaired prior to the start of school in September 2022, to assure the safety, health and welfare of the students, staff and visitors to HGHS, as well as to safeguard the School District’s property; and

WHEREAS, the Board is empowered to determine that the expense of these activities is an ordinary contingent expense within the meaning of §2023 of the New York State Education Law and §170.2(l) of the Regulations of the Commissioner of Education and that the project constitutes an emergency within the meaning of §103 of the General Municipal Law to allow for the repair of the pedestrian bridge and related activities on an immediate basis without the necessity of competitive bidding;

THEREFORE, BE IT RESOLVED, that the Board of Education hereby determines and declares that the cost of the repairs to the pedestrian bridge at HGHS, related work and incidental costs and expenses, constitutes an ordinary contingent expense within the meaning of §2023 of the Education Law and §170.2(l) of the Regulations of the Commissioner of Education, and constitutes an emergency within the meaning of §103 of the General Municipal Law and hereby authorizes the expenditure of those funds necessary for such purposes; and

BE IT FURTHER RESOLVED, that the Board hereby determines that the emergency repairs to the pedestrian bridge at HGHS, including related activities, will not have a significant environmental impact and declares this project a Type II Action pursuant to '617.5(c)(1) (maintenance or repair involving no substantial changes in the structure or facility) and/or (2) (replacement, rehabilitation or reconstruction of a structure or facility, in kind on the same site) and/or (10) (routine activities of educational institutions) of the State Environmental Quality Review Act regulations, and no further action is required; and

BE IT FURTHER RESOLVED, that the District Architect/Engineer are hereby authorized to immediately prepare any necessary specifications for this emergency project, and the Superintendent of Schools or designee is hereby authorized to file the necessary and proper paperwork with the New York State Education Department to proceed with the emergency repair of the pedestrian bridge at HGHS; and

BE IT FURTHER RESOLVED that the Board hereby authorizes the Superintendent of Schools or designee to make transfers between and within functional unit appropriations in the general fund in order to pay the costs of this ordinary contingent expense.

8.13    BE IT RESOLVED, that the Board of Education hereby approves an agreement for Claims Auditor Services with Jonathan Ross for the 2022-23 school year, in the amount of $120.00 per hour, and authorizes the Board President to execute this Agreement.

9.     BE IT RESOLVED, that the Board of Education acknowledges the following contracts approved by the Superintendent, per Board Policy 6085 – Purchasing and Bidding:
